(Terms and Conditions) The Terms and Conditions of Destiny Express (a company also referred to in this document as DE) contained herein were established to explain and define the rights and responsibilities of DE and its Independent Representatives. Each Independent Representative agrees, without reservation, to all the terms and conditions contained herein and hold DE free from any and all liability that may result from this agreement between the Independent Representative and DE. The Independent Representative, also referred to as IR, certifies to Destiny Express that they are over 18 years of age. The IR shall, under no circumstance, consider or present themselves as an employee of DE. The IR therefore understands that the various titles of positions which one can attain in the compensation plan, otherwise known here as the Pay Plan, does not constitute employment status with DE. The IR is responsible to make their own arrangements to pay any tax due on their earnings from DE to the relevant tax authority in their country of residence. Anti-Spam Policy In order to protect our subscribers and ensure the long term growth and success of Destiny Express, DE maintains a ZERO tolerance policy towards the sending of spam email. Spam email is defined as Unsolicited Commercial Email (UCE). In the event that you send spam email to people without their permission, you risk immediate cancellation of your account and forfeiture of all contacts in that account. As a Destiny Express subscriber, you understand that Destiny Express neither condones nor tolerates the sending of unsolicited or spam email by its subscribers. You understand and acknowledge that: Destiny Express will immediately terminate your subscription and suspend all future commissions for violating these Spam Policies. Destiny Express reserves the right to take legal action against any subscriber found violating this Spam Policy. You will not be eligible for a refund if you are terminated for violating the Destiny Express Spam Policy. Product and Earnings Policy Destiny Express monthly subscription fee is to pay for full access to the DE website provided by DE and its trainers. All active subscribers may also participate in the Destiny Express Power compensation program as outlined on the Pay Plan page of the website. All subscribers understand BEFORE paying their subscription fee that there are NO GUARANTEED EARNINGS. Subscribers understand that the Power line genealogy is not to reflect earnings, but to be a representation of company growth and does not mean anything in terms of commissions. Subscribers should not participate in Destiny Express under the expectation of earning income without referring new subscribers. Neither Destiny Express, nor its subscribers can guarantee "spill over" or earnings simply by becoming a subscriber. Destiny Express subscribers are encouraged to purchase products and services they believe they will benefit from as outlined on the Product and Compensation pages. Subscribers should not participate in Destiny Express if they are not planning on using the products, nor if they are not planning on sharing the opportunity with others. In the beginning, most subscribers will earn less money each month in the compensation program than they are paying to maintain their subscription in Destiny Express. Although it is possible, DE subscribers should NOT expect to make a profit simply by becoming a subscriber as it is highly unlikely that will occur.It is illegal for a promoter or a participant of a trading scheme to persuade anyone to make a payment by promising benefits from getting others to join the scheme. Do not be misled that high earnings are easily achieved. No subscriber should spend money that they cannot afford to lose to become a subscriber and maintain their subscription in Destiny Express. It is possible that you will NOT earn income as a subscriber of Destiny Express. Compliance Policy Destiny Express may change, alter, add, or detract conditions of subscription, products, services, and compensation at any time and for any reason. Destiny Express reserves the right to terminate a subscriber at any time for violating any of our policies regardless of fault. All disputes and claims relating to Destiny Express, this Agreement, the Destiny Express compensation plan, or its products, the rights and obligations of a Representative and Destiny Express, or any other claims or causes of action relating to the performance of either a Representative or DE under the Agreement or the rules and regulations, and/or a Representative's purchase of products shall be governed under the English Law and the parties hereby submit to the exclusive rights of the English Courts. Destiny Express and its affiliates, officers, directors, employees, and other representatives shall not be liable for, and the Representative hereby releases the foregoing from and waives any claim for loss of profit, incidental, special, consequential, or exemplary damages which may arise out of any claim whatsoever relating to DE's performance, non-performance, act, or omission with respect to the business relationship or other matters between the Representative and Destiny Express whether sounding in contract, tort, or strict liability. Cancellation and Refund Policy All Destiny Express subscribers must pay a monthly membership fee to maintain their subscription and have rights and access to all products, services, and the benefits contained in the Pay Plan. All subscribers recognize that the credit card they have on file will continue to be billed every 30 days until and unless that subscriber cancels his/her subscription with Destiny Express. There is no long term commitment or timeframe in which a subscriber must continue to remain active by paying their monthly subscription fee. Subscribers may cancel their subscription at any time for any reason simply by logging into their DE online subscribers and clicking on the User and Billing Info link where they are required to follow the Terminate Subscription link to cancel their subscription. No commissions can be earned by inactive subscribers. Destiny Express maintains a 21 day 100% refund policy. You must cancel your subscription within 21 days of upgrading to subscriber to be eligible for a refund. After you have been a subscriber for 21 days, no refunds either partial or full are given. The same 21 day policy applies to the monthly subscription payment. You can cancel your subscription within 21 days of the most recent charge and be eligible for a refund for that month's subscription fee only. After 21 days, no refunds either partial or full are given.Refunds are only given if the 21 day eligibility requirement is met and if the refund is requested. To request a refund, you must contact us via our form at http://www.destinyexpress.co.uk/contact.php you must include your Destiny Express username or ID number with a short message. Privacy Policy Destiny Express is committed to customer service and we intend to uphold this by providing a private and secure browsing experience at Destiny Express. We keep your personal information private. The following policy will help you to understand how we will treat your personal information. As a member of Destiny Express, we will use the information you provide through our contact forms, payment forms or email to communicate with you in response to a comment or a request you may have. We will do everything in our power to protect your contact details from third parties as a result of providing us with your information. As we continue to improve our site and as we take advantage of developments in technology, this policy may change from time to time so please check this policy on an ongoing basis for revisions and updates. Information and Collection Use: DE collects information from its web site in several ways. During registration, Destiny Express asks for information such as your name, email address, and post code or zip code. Once you have submitted this information and chosen a valid password, you will be able to take full advantage of everything Destiny Express has to offer. Upon Signing up as a PAID Member, some personal information will be asked of you. This information will consist of a billing address, phone, payment processing, etc. This information will not be seen by anyone other than the DE Support Team. Information is collected for the purpose of providing Destiny Express services. Information Disclosure: This is to let you know that when you submit your personal information, it will be seen by DE Support Team only. We assure you that no one else will have access to your information unless you request it.
